These terms constitute a legally binding agreement between you and SmartMenu SAS. We may modify these terms at any time, and such modifications will be effective immediately upon posting.

SmartMenu provides a comprehensive restaurant management platform that includes:

• Digital menu management and QR code ordering
• Table reservation system
• Kitchen display and order management
• Analytics and reporting tools
• Customer management features
• Multi-language support
• Payment processing integration

To access certain features of SmartMenu, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account
• Use the service only for lawful business purposes

SmartMenu operates on a subscription-based model with the following terms:

• Subscription fees are billed in advance on a monthly or annual basis
• All payments are processed securely through our payment partners
• Prices are subject to change with 30 days' notice
• Refunds are provided according to our refund policy
• Late payments may result in service suspension
• All prices are exclusive of applicable taxes

You agree not to use SmartMenu's services for any unlawful purpose or in any way that:

• Violates any applicable laws or regulations
• Infringes on intellectual property rights
• Contains malicious software or harmful content
• Attempts to gain unauthorized access to our systems
• Interferes with other users' use of the service
• Transmits spam, unsolicited communications, or illegal content

We are committed to protecting your data and privacy:

• We comply with GDPR and other applicable data protection laws
• Customer data is processed according to our Privacy Policy
• We implement appropriate technical and organizational measures
• Data breaches are reported within 72 hours as required by law
• You retain ownership of your restaurant and customer data

SmartMenu and its content are protected by intellectual property laws:

• SmartMenu owns all rights to the platform and its technology
• You retain rights to your content and restaurant data
• You grant us a license to use your content to provide services
• You may not copy, modify, or distribute our software
• Our trademarks and logos are protected

We strive to provide reliable service with the following commitments:

• 99.9% uptime guarantee with offline failsafe mode
• 24/7 technical support for critical issues
• Regular system maintenance and updates
• Data backup and disaster recovery procedures
• Advance notice of scheduled maintenance

To the maximum extent permitted by law:

• SmartMenu's liability is limited to the amount paid in the last 12 months
• We are not liable for indirect, consequential, or punitive damages
• You use the service at your own risk
• We do not guarantee uninterrupted or error-free service
• Force majeure events excuse performance obligations

Either party may terminate this agreement:

• You may cancel your subscription at any time
• We may suspend or terminate accounts for breach of terms
• Data export is available for 30 days after termination
• Prepaid fees are refundable on a pro-rata basis
• Certain provisions survive termination

These terms are governed by French law:

• Governed by the laws of France
• Disputes subject to the jurisdiction of French courts
• EU customers have additional rights under EU law
• Mediation available for dispute resolution
